The Complaint seems lacking in seriousness as it inaccurately recites objective facts, implies statutory language that does not exist, and ignores statutory language that does exist.
Excellent! I have avoided the news and articles about the mess in California. My spouse is a tv news addict so I can only avoid so much. This is the only substack I’ve read on the subject even though every one of those I subscribe is writing about it. This article was what I needed. Thanks.
" ... the Attorney General has opted to file in the San Francisco Division of the Northern District of California even though the State Capitol — Sacramento — is in the Eastern District, and the troops are being deployed to Los Angeles in the Central District. The justification for filing in San Francisco?"
The justification is forum shopping - it is more than probable they have a judge all lined up to issue an injunction. This would be a horrendous, extra-judicial act, of course, as it would expose ICE agents and federal facilities to interference and attacks by the mobs. But Dem Judges don't care about such things.
These are some nice write-ups on all these current legal issues, by the way. Thanks, Ship!
An additional ‘plus’ is that the entirety of this ‘unrest’ has been memorialized by hundreds of cellphone and videographers, so that we are not at the mercy of edited filming, as occurred i the Rodney King situation. And yes, while I’m, not an attorney, I’ve been following (reading) some of these submissions to the court, and have been truly appalled by the amount of immaterial verbiage, repetition and bloat that any high school kid, given an assignment that must be a specific length, would use.
These filings will continue to be constructed and written in the format of a Harlequin romance novel until such time as judges begin to slap them down for the trash they are and potentially sanction the parties who submit them as wasting the courts time.
Waiting for a cold day in hell before that would ever happen in Commiefornia.
There are other situations involving federal troops during the civil rights era but these mainly involved protecting black students attending schools in Arkansas, Alabama, etc. In one case, the governor famously stood in the doorway until pushed aside by federal uniformed officers. The distinction is that military was protecting citizen rights as opposed to federal lives and property. JFK nearly blew a gasket when he learned of a active duty division commander handing out John Birch Society pamplets to the troops. Conversations captured in the Oval on tape.
Trump faced the same issue with the Portland Federal Courthouse but tried to solve it without military assistance. Seemed to learn more lessons with Minneapolis igniting the BLM riots. So, LA is a faster ramp. By Article II, it is the sworn duty to preserve the Union. Here Trump joins the likes of Lincoln and Kennedy. Dangerous company indeed.
Excellent color. Just some musings of my own. The only historical event where a US president invoked force of similar scale to protect federal property was Fort Sumter in 1861. Lincoln did not consult with the governor of South Carolina. The president just shifted troops from Ft. Mountrie in the middle of the night to occupy a fort under construction in the harbor. By the way, there were negotiations underway to purchase Ft. Sumter from the US since it protected Charleston harbor.

And an activist judge rules against the US Government in 3....2....1.
Newsom's complaint is a press release and publicity stunt dressed up as a civil complaint filed in court
" ..At no point in the past three days has there been a rebellion or an insurrection..."
I'll see your rebellion and insurrection and raise you an invasion!
Nothing can happen to the democrats that could make me feel sorry for them.

Thank you so much for this presentation. Great work!
