The Dispute Between The Trump Administration and Federal Judge Over Removing Venezuelan Terrorists As "Alien Enemies."
Here is a timeline of events and the disputes now before both the District Court and the Appeals Court regarding the lawfulness of the Court's TRO.
Why are these guys smiling? Do they think they are going to get to come back to the United States?
There are some errors beginning to show up in various posts about the events that had resulted in the dispute between the Trump Administration and DC District Court Judge James Boasberg (pronounced "Bose" not "Bos" -- if some "journalists" covered this Judge as much as they claim, you'd think they would know how to pronounce is last name).
3/14, time uncertain:
Pres. Trump signs the Proclamation declaring Tren de Arugua (TdA) members to be "alien enemies" triggering his discretion to remove them under procedures he is authorized to develop by the Alien Enemies Act of 1798 — Title 50 U.S.C. Sec. 21.
3/15, approximately 9:00 am:
Civil lawsuit filed on behalf of 5 individuals, identified by their initials, and seeking class certification. The suit stated that invocation of the Alien Enemies Act had not yet taken place, but there was an expectation that Pres. Trump would sign and Proclamation "imminently" and that Proclamation would make members of TdA "alien enemies." All 5 individuals claimed they were not members of TdA, and they feared persecution if sent to Venezuela.
3/15, time uncertain:
Judge Boasberg said in the hearing later in the day he was contacted by the Clerk's Office re an emergency TRO filed to prevent imminent deportation of Plaintiffs as alleged in Complaint. After reviewing complaint and affidavits submitted with TRO motion, he entered TRO but ONLY regarding the 5 named individuals as there was still no public notice that a Proclamation invoking AEA had been issued by Pres. Trump. He set a hearing at 4:00 pm on 3/17. At some time after the initial Minute Order setting the hearing at 4:00 pm, another Minute Order moved the hearing back to 5:00 pm.
Prior to the hearing, the DOJ filed a Notice of Appeal with regard to the morning TRO.
3/15, 5:00 pm: Hearing Begins.
