The Fulton County Search Warrant Is The Beginning -- Not The Middle Or End -- Of Gathering Evidence Related To The 2020 Election

Search warrants are "kicking over the rocks" -- an opportunity to take and examine the evidence that is being withheld and cannot otherwise be examined without the seizure.

For the first time in more than 5 years someone other than Fulton County and the State of Georgia will have an opportunity to examine the ballots cast in that county in the 2020 Presidential election.

The endless caterwauling in the media and by the Democrats that the search warrant affidavit merely repeats debunked conspiratorial allegations that were rejected by numerous courts over the intervening 5 years fail to acknowledge two key points:

• Many if not most of the adverse court rulings came against the standard of whether the Trump Campaign could show “outcome determinative” levels of fraud sufficient to allow even an investigation of the ballots to take place;

• The exonerations of Fulton County’s Election Officials and the Georgia Secretary of State’s handling of the voting and its aftermath were given by …

  Fulton County and the Georgia Secretary of State’s Office.

An Affidavit in support of a search warrant is provided to the Court for the purpose of establishing probable cause to believe that a crime has been committed, and that evidence of that crime will likely be located in the location(s) for which a search warrant is sought.

There is no need for the affidavit to name suspects — in many instances it might be the case that those identities are not known at the time the search warrant is sought. The documents to be seized are likely to be the source of that information.

As for probable cause that a crime has been committed, the Affidavit submitted by the FBI Agent references one “record keeping” statute with regard to election records for federal elections. It requires the retention for a fixed period of time of “all records and papers which come into his possession relating to any …act requisite to voting in such election.”
